The Office of the Director of Public Prosecutions (ODPP) has formally approved murder charges against Police Constable Klinzy Masinde Baraza in connection with the killing of Boniface Kariuki, a street vendor who sold face masks in Nairobi’s Central Business District (CBD).

Kariuki was fatally shot on June 17, 2025, in a widely publicized incident that sparked national outrage after a disturbing video surfaced online showing the vendor being shot at close range.

The footage showed Constable Baraza and another officer confronting Kariuki during an apparent altercation before the fatal gunshot was fired.

According to the DPP, following a thorough investigation by the Independent Policing Oversight Authority (IPOA) and review of all available evidence, including eyewitness accounts and video footage, the decision was made to charge Baraza with murder. The ODPP stated that the evidence indicated clear criminal liability on the part of Constable Baraza.

Kariuki, a well-known figure in the CBD, was described by traders and pedestrians as a calm and hardworking young man. His death reignited public criticism of police brutality and the use of excessive force by law enforcement officers, particularly against informal workers in urban areas.

His co-accused, Police Constable Duncan Kiprono, who was present during the shooting and appeared in the viral footage, has been released without charge.

The DPP said there was insufficient evidence linking Kiprono to the act of murder, despite his presence at the scene.

Boniface Kariuki is set to be laid to rest later this week, with human rights activists and members of the public expected to attend his burial in solidarity with his grieving family.

The impending court proceedings against Constable Baraza mark a significant step in holding police officers accountable for abuses committed while on duty. Advocacy groups have urged the judiciary to ensure a transparent and speedy trial.
