The Office of the Director of Public Prosecutions (ODPP) has officially approved murder charges against six individuals, including senior police officers, in connection with the death of Albert Omondi Ojwang.

The suspects were arraigned at the Kibera High Court today, in a move signaling renewed scrutiny over alleged police misconduct and accountability in Kenya’s law enforcement.

In a statement released Monday, the ODPP confirmed that it had reviewed an investigation file submitted by the Independent Policing Oversight Authority (IPOA) and found sufficient evidence to charge the six suspects with murder, contrary to Section 204 of the Penal Code, Cap. 63 of the Laws of Kenya.

Key Suspects Include Senior Police Officers

Among those facing charges is Samson Kiprotich Talaam, the Officer Commanding Station (OCS), along with fellow police officers James Mukhwana and Peter Kimani. The remaining suspects are civilians identified as John Ngige Gitau, Gin Ammitou Abwao, and Brian Mwaniki Njue.

The suspects are set to appear in court at 2:00 PM today to answer to the murder charges.

Investigations Prompted by DPP Directive

The move follows a directive issued on June 10, 2025, by the Director of Public Prosecutions, invoking Article 157(4) of the Constitution and Section 5(2) of the ODPP Act, which empowers the DPP to order investigations in the public interest. In this instance, the DPP instructed IPOA to investigate the circumstances surrounding the death of Albert Omondi Ojwang.

IPOA concluded its investigations and submitted the inquiry file to the ODPP on June 22, whereupon a team of senior prosecutors was immediately tasked with reviewing the findings. Following their comprehensive assessment, the ODPP found that the evidence supported the prosecution of all six individuals involved.

Commitment to Justice and Accountability

The ODPP emphasized its commitment to upholding justice and accountability, particularly in cases involving public officers. “The Office of the Director of Public Prosecutions remains committed to executing its constitutional mandate in accordance with the rule of law, public interest, and administration of justice,” the statement read.

The death of Albert Omondi Ojwang has drawn public interest, with calls from human rights organizations urging swift action and transparency in handling the case. The arraignment marks a significant step toward accountability in a justice system often criticized for slow or ineffective prosecution in cases involving law enforcement.

As the legal process unfolds, attention will be focused on the outcome of the case, with expectations high that justice will be served for the late Albert Omondi Ojwang and his family.
